1. General Terms of Cancellation
Once a service has been contracted and payment has been processed, cancellations are generally not permitted. HelpStudyAbroad.com operates with a non-cancellable policy for the majority of its services due to the nature of our work, which involves immediate resource allocation and consultation efforts.
Non-cancellable services include:
- Application assistance services
- Consultation and advisory services
- Visa processing services
- Educational loan assistance
- Admission application review and submission
However, there are specific cases where cancellations may be permitted under exceptional circumstances, subject to the conditions outlined below.
2. Exceptional Circumstances for Cancellations
HelpStudyAbroad.com acknowledges that unforeseen situations may arise that could necessitate cancellation of services. Cancellations may be considered in the following exceptional circumstances:
- Program Cancellations by Educational Institutions: If a student’s selected program is canceled by the institution, cancellation of our services may be requested.
Important Note: Each cancellation request will be reviewed on a case-by-case basis. HelpStudyAbroad.com reserves the right to decline any cancellation request if it does not fall within the exceptions listed above.
3. Cancellation Request Procedure
In the event that you qualify for cancellation under the exceptional circumstances outlined, the following process must be followed:
- Written Notification: You must provide a formal request for cancellation via email to info@HelpStudyAbroad.com. The request must include your full name, application number, service engaged, and a detailed explanation of the reason for the cancellation request.
- Supporting Documentation: Any necessary supporting documentation must be submitted alongside the cancellation request (e.g., program cancellation notice, etc.).
- Review Process: Once all necessary information and documentation have been received, HelpStudyAbroad.com will review the request. This review process may take up to 10 business days.
- Decision Notification: You will be notified in writing of the outcome of your cancellation request. The decision made by HelpStudyAbroad.com will be final and binding.
4. Refund Policy
If a cancellation is approved in accordance with Section 2, a refund may be issued under the following conditions:
a. Non Refundable Fees
The following fees are non-refundable under all circumstances:
- Application fees paid to educational institutions
- Third-party fees (e.g., visa processing, document notarization, etc.)
- Any administrative charges already incurred as part of the service delivery
Refunds will only apply to specific services rendered by HelpStudyAbroad.com that have not yet been fully performed at the time of the cancellation request. For instance:
- If the application processing service has not been completed, a partial refund may be considered.
Refund amounts, where applicable, will not exceed 95% of the total amount paid. A 5% deduction will be applied to account for administrative charges and payment gateway fees.
c. Refund Process
- Submission of Refund Request: If your cancellation request is approved, you must formally request a refund in writing.
- Refund Processing Time: Once approved, refunds will be processed within 14 business days from the date of the refund request. The actual time for the funds to reflect in your bank account may vary based on your financial institution’s policies, particularly in cases of international transfers. If the refund is not received within 21 days, please contact us at info@HelpStudyAbroad.com.
- Currency of Refund: Refunds will be issued in the same currency in which the original payment was made. Any bank or currency conversion fees associated with the refund will be deducted from the total refundable amount.
5. Non-Refundable Services
Certain services provided by HelpStudyAbroad.com are inherently non-refundable due to the nature of their delivery. These include:
- Services already rendered (including completed application processes or consultations)
- Personalized advisory services (once the consultation has occurred)
- Customized visa and financial assistance services
Refunds will not be granted for dissatisfaction with outcomes that are outside of HelpStudyAbroad.com’s control, such as denial of visa applications by governmental authorities or non-acceptance to academic programs.
6. Chargebacks and Disputes
By using our services, you agree not to initiate any chargeback request with your bank or payment provider unless:
- You have exhausted all dispute resolution mechanisms with HelpStudyAbroad.com and
- HelpStudyAbroad.com has failed to resolve your dispute within a reasonable time frame.
Unauthorized chargebacks may be contested, and you may be liable for all costs associated with recovering the amount of the chargeback, including legal fees and other expenses incurred.
7. Legal Framework and Dispute Resolution
This cancellation and refund policy is governed by the laws of India. Any disputes arising from this policy or any services rendered by HelpStudyAbroad.com will be subject to the exclusive jurisdiction of the courts in Delhi, India.
HelpStudyAbroad.com’s decision regarding cancellation and refund requests will be final and binding. In case of any dispute, we encourage clients to first attempt resolution through negotiation or mediation. Should mediation fail, legal recourse may be pursued as a last resort, following applicable law.
8. Amendments to Policy
HelpStudyAbroad.com reserves the right to amend or update this cancellation and refund policy at any time. Changes will be effective immediately upon posting on our website, and it is the client’s responsibility to review the policy periodically.
